This Privacy Policy explains how Sod Solutions, Inc. ("Sod Solutions," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit sodsolutions.com and related websites, make a purchase, create an account, subscribe to our newsletters, or otherwise interact with us (collectively, the "Services").

By using the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use the Services.

1. Information We Collect

We collect personal information that you provide directly, information collected automatically as you use the Services, and information from third parties.

Information you provide to us

  • Identifiers and contact data: name, billing and shipping address, email address, and phone number.
  • Order and transaction data: products purchased, order history, order value, and delivery details.
  • Payment information: payment card or other payment details, which are collected and processed by our payment processor (see Section 4). We do not store full payment card numbers on our systems.
  • Account data: username, password, and saved preferences if you create an account.
  • Communications and marketing data: newsletter subscriptions (such as our Sod University newsletter), survey responses, product reviews, and the content of messages you send to our support or sales teams.
  • Property and lawn data: information you voluntarily provide about your lawn, grass type, zip code, soil, or property to receive product recommendations or guidance.

Information collected automatically

  • Device and usage data: IP address, browser type, operating system, device identifiers, referring/exit pages, pages viewed, links clicked, and timestamps.
  • Cookies and similar technologies: see Section 5.
  • Approximate location: derived from your IP address or shipping zip code.

Information from third parties

  • Order, fulfillment, and delivery updates from shipping and logistics providers and, where applicable, licensed sod farms that fulfill local sod orders.
  • Marketing, analytics, and advertising partners that help us measure and improve our campaigns.
  • Fraud-prevention and identity-verification signals from our payment processor and security providers.

2. How We Collect Information

We collect information when you browse the Services, place or track an order, create or log into an account, subscribe to a newsletter, complete a form or calculator, contact us, participate in a promotion or survey, or interact with our emails and advertisements.

3. How We Use Your Information

We use personal information to:

  • Process, fulfill, ship, and track your orders, including coordinating local sod delivery through licensed farms where applicable;
  • Process payments, calculate applicable taxes, and prevent fraud;
  • Create and manage your account and provide customer support;
  • Send transactional communications such as order confirmations, shipping notices, and order-status updates;
  • Send marketing communications, including the Sod University newsletter, promotions, and product recommendations (subject to your choices in Section 7);
  • Personalize content and product recommendations, including lawn-care guidance based on grass type and location;
  • Operate, maintain, analyze, and improve the Services and our products;
  • Measure the effectiveness of our marketing and advertising;
  • Comply with legal obligations, enforce our Terms and Conditions, and protect the rights, safety, and property of Sod Solutions and others.

4. How We Share Your Information

We do not sell your personal information for money. We share personal information in the following circumstances:

We require service providers to use personal information only to perform services for us and to protect it consistent with this Policy. We may also share aggregated or de-identified information that cannot reasonably be used to identify you.

5. Cookies and Tracking Technologies

We and our partners use cookies, web beacons, pixels, and similar technologies to operate the Services, remember your preferences and cart, analyze traffic, and support marketing. Categories include:

  • Strictly necessary - required for core functions such as checkout, security, and account login.
  • Functional - remember preferences and improve usability.
  • Analytics/performance - help us understand how the Services are used (e.g., Google Analytics).
  • Advertising/targeting - support and measure advertising (e.g., Meta/Facebook Pixel, Google).

You can manage non-essential cookies at any time through your browser settings. Disabling some cookies may affect how the Services function.

6. Analytics and Advertising

We use Google Analytics and Google Tag Manager to understand site usage, and the Meta/Facebook Pixel and Google advertising tools to deliver and measure advertising. These partners may set cookies and collect information about your activity across sites and over time to provide interest-based advertising. You can learn about and opt out of certain interest-based advertising through the Digital Advertising Alliance, the Network Advertising Initiative, and your device or browser settings. For Google Analytics, you may use the Google Analytics Opt-out Browser Add-on.

Do Not Track and Global Privacy Control

Some browsers offer a "Do Not Track" (DNT) signal. Because there is no common industry standard for DNT, we do not currently respond to DNT signals.

7. Your Choices

  • Marketing email: unsubscribe using the link in any marketing email or by contacting us. You will continue to receive transactional messages related to your orders.
  • Cookies: manage preferences through your browser.
  • Account: review and update your account information when logged in, or contact us for help.
  • Text messages (if offered): reply STOP to opt out of marketing texts.

8. California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA"), gives you the rights described below.

Categories of personal information we collect

In the preceding 12 months, we have collected the following categories of personal information (as defined by the CCPA): identifiers; customer records (e.g., name, contact, payment information); commercial information (e.g., purchase history); internet or other electronic network activity (e.g., browsing and interaction data); geolocation data (approximate); and inferences drawn from the above. We collect this information for the business and commercial purposes described in Sections 3 and 6.

Sources and disclosure

We collect these categories from the sources in Section 2 and disclose them to the categories of recipients in Section 4.

"Sale" and "sharing" of personal information

We do not sell personal information for monetary consideration. However, our use of advertising and analytics technologies (such as the Meta/Facebook Pixel and Google advertising tools) may be considered "sharing" for cross-context behavioral advertising, or a "sale," under the CCPA. You have the right to opt out. To exercise this right, contact us as described in Section 14.  We do not knowingly sell or share the personal information of consumers under 16 years of age.

Your CCPA rights

  • Right to know the categories and specific pieces of personal information we have collected, the sources, purposes, and the categories of recipients.
  • Right to delete personal information we have collected, subject to legal exceptions.
  • Right to correct inaccurate personal information.
  • Right to opt out of the sale or sharing of personal information.
  • Right to limit the use of sensitive personal information (note: we do not use or disclose sensitive personal information for purposes that trigger this right).
  • Right to non-discrimination for exercising your rights.

How to exercise your rights

Submit a request by emailing support@sodsolutions.com. We will verify your request by matching information you provide with information in our records. You may use an authorized agent to submit a request on your behalf, subject to verification. We will respond within the timeframes required by law (generally 45 days, extendable as permitted).

9. Data Retention

We retain personal information for as long as needed to provide the Services, complete transactions, comply with our legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. Retention periods vary by data type and purpose.

10. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Children's Privacy

The Services are intended for adults and are not directed to children under 13 (or under 16 where applicable). We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will take appropriate steps to delete it.

12. Third-Party Links

The Services may link to third-party websites, including our turfgrass brand sites and partner stores. We are not responsible for the privacy practices of those third parties. Review their privacy policies before providing information.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version with a new "Last updated" date and, where required, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance.
